EMERGENCY CLOSURE - FIRE

BOULDER CREEK WILDERNESS

UMPQUA NATIONAL FOREST

Pursuant to Title 36 CFR Part 261.50(a) and (b), the following acts are prohibited within the boundaries of the Umpqua National Forest, Boulder Creek Wilderness Area, as described in this order and attached map to provide for public health and safety due to active fire and extreme fire conditions in the area until September 30th, 2008, or unless sooner rescinded:

1) Being on the road. [36 CFR 261.54(e)]

Forest Service Roads which run adjacent to and within the Boulder Creek Wilderness as follows: #2800-700, 2800-720, 3402, 3402-490, 3402-500, 3402-502, 3402-503, 3402-504, 3402-800, 3402-801, 3810, 3810-200, 3810-302, 3810-360, 3810-363, 3810-380, 3810-384, 3810-389, 3810-436, 3810-445, 3816-200, 3850, 3850-200, 3850-350, 3850-370, 3850-372, 4700, 4760, 4760-039, 4760-041, 4760-050, 4760-060, 4760-100, 4760-102, 4760-104, 4760-105, 4760-110, 4773, 4775, 4775-010, 4775-011, 4775, 4775-400, 4775-450, 4775-454, 4775-500, 4775-600, 4775-700, 4775-710, 4775-900.

2) Being on a trail. [36 CFR 261.55 (a)]

Trails that run adjacent to and within the Boulder Creek Wilderness as follows: #1414, #1486, #1487, #1488, #1491, #1492, #1493, #1532, #1534, #1535, #1539, #1543, #1552, #1553, and #1554.

The legal locations of the closed area are bounded by roads and trails adjacent to and within the Boulder Creek Wilderness Areas. They are as follows:

T. 25S., R.2E, Sections 24, 25, 26, 34, 35, 36.

T. 25S., R.3E, Sections 15-22 and 27-35.

T.251/2S., R.2E, Sections 34, 35, and 36.

T.251/2S., R.3E, Sections 31, 32, 33, 34, and 35.

T.26S., R.2E, Section 1, 2, 3, 10-15.

T.26S., R.3E, Sections 2-8, 17, 18.

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:

·1) Person with a permit specifically authorizing the prohibited act or omission.

·2) Owners or lessees of land in the area.

·3) Any Federal, State or local Officer or member of an organized rescue or fire fighting force in the performance of an official duty.

These prohibitions are in addition to the general prohibitions in Title 36 CFR Part 261, Subpart A.

This order will become effective immediately.

Violation of this prohibition is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization or imprisonment for not more than 6 months or both, Title 16 U.S.C, Section 551 and USC 18 U.S.C. 3559 and 3571.
