UNITED STATES DEPARTMENT OF AGRICULTURE FOREST SERVICE ORDER No. 14-12-02 SHASTA-TRINITY NATIONAL FOREST BAGLEY FIRE EMERGENCY CLOSURE AMENDMENT 3
Pursuant to 16USC 551 and 36 CFR261.50(a) and (b), and to provide for public safety, the following acts are prohibited within the Shasta Lake and McCloud Ranger Districts of the Shasta-Trinity National Forest. This Order is effective from August 25, 2012, and revised as Amendment 1 on August 27, 2012, and as revised as Amendment 2 on September 11, 2012, and revised as Amendment 3 on October 1, 2012 until the Bagley Fire has been fully suppressed. The closed area described in this order will be consistently evaluated and modified based on fire behavior and fire operations in the affected areas.
1. Going into or being upon National Forest System lands within the Bagley Fire Closure Area. The Bagley Fire Closure Area begins at the intersection of Forest Road No. 34N17 and Forest Road No. 35N46, then continues west along Forest Road No. 34N17 to its intersection with Forest Road No. 35N56, then continues north along Forest Road No. 35N56 to its intersection with Forest Road No. 35N55, then continues northerly along Forest Road No. 35N55 to its intersection with Forest Road No. 36N67, then continues north along Forest Road No. 36N67 to its intersection with the section line between Sections 22 and 23 of Township 36 North, Range 3 West, Mt. Diablo Base and Meridian, then continues north along the section lines to its intersection with the south riverbank of the McCloud River, then continues along the south riverbank to the confluence with Hawkins Creek, then continues east to intersection of Forest Road No. 38N1 land the north section line of Section 35 Just south of the crossing of the Pacific Crest trail, then continues southerly along Forest Road No. 3 8N11 to its intersection with Forest Road No. 37N66Y, then continues directly west to the intersection with Iron Canyon Reservoir shoreline in Township 37 North, Range 1 West, Section 16, then continues along the circumference of the Iron Canyon Reservoir shoreline back to its starting point, then continues with the section line between Sections 21 and 22 of Township 37 North, Range 1 West on the southern shoreline of Iron Canyon Reservoir, then continues south along the section lines to the intersection with Forest Road No. 37N34, then continues south along Forest Road No. 37N34 to the intersection with the section line between sections 27 and 34 of Township 37 North, Range 1 West, then continues east along the section lines to its
intersection with the Forest boundary, then continues south along the Forest boundary to its intersection with the section lines between Sections 16, 17, 20 and 21 in Township 35 North, Range 1 West, then continues south along the section lines to its intersection with the Pit River, then continues west along the Pit River to its intersection with Forest Road No. 34N17, then continues westerly along Forest Road No. 34N17 back to the starting point, as shown on Exhibit A. The water surface of Iron Canyon Reservoir will remain open, however its shoreline is
closed as described above and depicted on Exhibit A. 36 CFR 261.53(e).
2. Being on any National Forest System trail within the Bagley Fire Closure Area, as shown on Exhibit A. 36CFR261.55(a).
3. Being on any National Forest System road within the Bagley Fire Closure Area. Additionally, Forest Road No. 39N21 is closed beginning at the intersection with Forest Road No. 38N11 and includes Forest Road Numbers 39N21 A, 38N94, 38N56, 38N95, 38N97 and 38N98, and Forest Road No. 38N36 is closed beginning at the intersection with Forest Road No. 38N53 and includes Forest Road Numbers 38N36A, 38N84, 38N84A and 38N84B, as shown on Exhibit A.
36CFR261.54(e).
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:
1. Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.
2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
3. Owners or lessees of private land in the Bagley Fire Closure Area to the extent necessary to gain access to their land.
4. Persons who reside on private land in the Bagley Fire Closure Area to the extent necessary to gain access to their residences.
5. Persons engaged in a business, trade, or occupation in the Bagley Fire Closure Area.
These prohibitions are in addition to the general prohibitions found in 36 CFR Part 261, Subpart A.
A violation of these prohibitions is punishable by a fine of not more than $5,000.00 for an individual or $10,000 for an organization, or imprisonment for not more than six (6) months, or both. 16 USC 551 and 18 USC 3559, 3571 and 3581.
