ORDER
FIRE RESTRICTIONS
SHOSHONE NATIONAL FOREST
Partial Fire Restriction Order
Pursuant to 16 U.S.C. 551 ,and 36 CFR § 261.50(a), the following acts are prohibited on all National Forest System lands within the Shoshone National Forest, in the following counties within the state of Wyoming ("the restricted area"), Fremont, Hot Springs, and Park. The restricted area is depicted on the attached map, hereby incorporated into this Order as Exhibit A.
PROHIBITIONS:
- Building, maintaining, attending or using a fire, campfire, charcoal, coal, wood stove, or, except within a designated developed recreation site. Designated developed recreation sites are identified in the attached list and are herby incorporated into this order as Exhibit B. 36 C.F.R. § 261.52(a). Campfires are allowed in Forest Service installed metal rings within designated developed recreation sites. The use of portable stoves and lanterns using gas, jellied petroleum, pressurized liquid fuel or a fully enclosed (sheepherder type) stove with a ¼" spark arrester type screen are allowed providing such devices meet the fire underwriters specifications for safety.
- Smoking, except within an enclosed vehicle or building, a developed recreation site, or while stopped in an area at least three feet in diameter that is barren or cleared of all flammable material. 36 C.F.R. § 26 1.52(d).
3. Using an explosive. 36 C.F.R. § 261.52(b).
- Operating or using any internal or external combustion engine without a spark arresting device properly installed, maintained, and in effective working order meeting either:
----- Department of Agriculture, Forest Service Standard 5100-1a; or
----- Appropriate Society of Automotive Engineers (SAE recommended practice J335(b) and J350(a). 36 C.R.R. § 261.52(j).
5. Welding or operating an acetylene torch with open flame. 36 C.F.R. § 261.52(i).
EXEMPTIONS:
Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this order:
1. Persons with a Forest Service permit specifically authorizing the prohibited act or omission.
2. Any Federal, State or Local Officer or member of an organized firefighting force in the performance of an official duty.
This Order is necessary to protect public health and safety due to the current fire danger and activity.
This Order becomes effective at 8:00 AM, July 7, 2007, and will remain in force until rescinded or until December 31, 2007, which event ever occurs first.

Violations of these regulations is punishable as a Class B misdemeanor, by a fine of not more than $5000 for an individual or $10,000 for an organization, or imprisonment for not more than six (6) months or both. 16 USC § 551, and 18 USC §§ 3559 and 3571.
